The honest answer is that Florida law sets a range, not a fixed penalty, and where a case lands within that range depends heavily on the facts, the arresting agency, and how the case is handled from the very beginning.

Most first time DUI cases in Monroe County resolve without jail time, but that outcome is never guaranteed. However, a thoroughly prepared defense can make a huge difference. What Florida Law Actually Allows for a First Offense

Florida law treats driving under the influence as a single offense that can be proven either through visible impairment of normal faculties or through a blood or breath alcohol level at or above .08. For a first conviction, the fine generally runs not less than $500 and not more than $1,000, though that range increases to between $1,000 and $2,000 if the blood or breath alcohol level was .15 or higher, or if there was a minor in the vehicle.

Jail exposure follows a similar pattern. A first conviction generally allows imprisonment of up to six months, or up to nine months where the alcohol level was .15 or higher or a minor was present. Combined probation and incarceration typically cannot exceed one year, and courts have discretion to let part of that sentence be served through a residential treatment program rather than a jail cell, with that time credited toward the sentence. On top of that, most first-time cases carry a mandatory community service component, usually 50 hours, along with a short vehicle impoundment period.

License consequences hit almost everyone. A first-time administrative suspension for a driver over 21 with an alcohol level of .08 or above typically runs six months. However, a suspension that is part of a sentence for a criminal conviction ranges from 180 to 365 days. For most people living in the Keys, losing driving privileges is a real problem. While there are public transit options, the commutes can be difficult. For visitors from out of state, that suspension will follow them home. Each state has its own rules for license suspension after a DUI.

One Statute, Two Separate Fights

Here’s something people don’t expect. A DUI arrest actually triggers two entirely separate legal processes. There’s the criminal case that plays out in Monroe County court, and there’s a completely separate administrative license suspension handled through the state’s highway safety department. The administrative clock starts running once the notice of suspension is issued, and it moves fast. Miss that early 10-day window to request a hearing, and the suspension often takes effect regardless of what eventually happens in the criminal case. Florida also ties the court’s hands in ways some clients find surprising. In plain terms, a DUI conviction usually sticks as a permanent conviction on your record, not something a judge can quietly soften after the fact. That single fact changes how we approach negotiations from day one.

Why Monroe County Cases Move Differently

About those administrative hearings… they matter more here than people realize, and not just because of the statute. Key West runs its own DUI enforcement out of the police department, and between the Sheriff’s Office, Florida Fish and Wildlife (which has jurisdiction to issue traffic violations), and Florida Highway Patrol, there’s a lot of coverage on a fairly small stretch of road. Duval Street on a Friday night, the Truman Avenue corridor, the checkpoints that sometimes pop up heading toward the bridges, all of it gets attention, especially during lobster season and the winter tourist crush when the bars are packed and the sidewalks spill into the street.

Acting within that first ten day window after the notice of suspension, getting the arrest report, reviewing the breath test maintenance records, and requesting the administrative hearing promptly can shape the entire trajectory of the case. Most people hire an attorney too late. By then, evidence can get lost and witnesses’ memories have already started to fade.

What a Typical Outcome Looks Like

So, back to the original question. The most common outcome for a first time DUI in Key West, when there’s no accident, no minor passenger, and a BAC under .15, tends to involve some combination of a fine in the lower part of the statutory range, a license suspension, mandatory DUI school, probation, and community service, with jail time either avoided entirely or served as a short mandatory minimum depending on the judge and the specific facts. That’s not a guarantee. It’s a pattern we’ve observed, and it can shift quickly based on aggravating circumstances, the arresting officer’s report, and how the evidence holds up. To clarify that last point, “avoiding jail” doesn’t mean avoiding consequences. A DUI conviction in Florida generally stays on a person’s criminal record permanently and cannot be sealed or expunged. That’s a heavier weight than most first time clients expect when they walk into our office, and it’s exactly why we push for early, thorough case review rather than a quick plea just to make the court date disappear.
